DMCA & Copyright Policy

VodiCast respects the intellectual property rights of others and expects its users to do the same. If you believe that content available through VodiCast infringes your copyright, you may submit a formal notice under the United States Digital Millennium Copyright Act (DMCA) and/or the Canadian Copyright Act's Notice-and-Notice regime.

How to file a takedown notice

To be effective, your notice must include all of the following elements:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate it — including the exact URL or channel name on VodiCast.
  4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number and, if available, an email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our response

Upon receipt of a valid notice we will: (a) acknowledge receipt within 48 hours; (b) investigate the claim; (c) where appropriate, remove or disable access to the allegedly infringing content; (d) take reasonable steps to notify the affected customer.

Counter-notice procedure

If you believe content was removed in error, you may submit a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the content that has been removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the content was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district in which your address is located (or, if outside the United States, the courts of Quebec, Canada).

Repeat-infringer policy

It is VodiCast's policy to terminate subscriptions of users who are repeat infringers as required by applicable law. We may also terminate subscriptions of users who in our sole discretion infringe the rights of others.

Misrepresentations

Any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by VodiCast.
